Alabama law to prohibit vaping in indoor public spaces

A new Alabama law, Senate Bill 9 (Act 2026-505), will prohibit vaping in indoor public spaces where smoking is already restricted starting October 1, 2026. The legislation redefines smoking to include the use of electronic nicotine delivery systems, effectively extending the protections of the Alabama Vivian Davis Figures and Barbara Drummond Clean Indoor Air Act to e-cigarettes.

The restrictions apply to enclosed public locations such as hospitals, libraries, government buildings, schools, and retail stores, as well as covered areas of restaurants, workplaces, and sports facilities. Private residences are excluded from these mandates.

State Health Officer Dr. Scott Harris stated the law is intended to reduce exposure to tobacco smoke and chemicals in shared spaces. The Alabama Department of Public Health is advising businesses and organizations to review their smoking policies and update posted signage to reflect the new regulations before the implementation date.
