Alagoas court limits Public Security Council powers

A court in Alagoas has limited the authority of the State Public Security Council (Conseg/AL), ruling that it may only perform advisory and consultative functions. The decision by the 16th Civil Court of the Capital follows a civil public action by the Alagoas State Public Prosecutor's Office (MP/AL).

The ruling states that the state law previously granting the council punitive and regulatory powers conflicts with Federal Law No. 13.675/2018, which establishes that security councils must act in a consultative and social monitoring capacity. Consequently, the government of Alagoas is prohibited from using the council to punish or suspend civil servants, initiate disciplinary processes, or create mandatory rules for security agencies.

The court has granted a 120-day period for the state to present a restructuring plan for the body to align with federal regulations. While the judge denied the prosecutor's request to force the government to submit a specific bill, the decision is subject to appeal.
