Albacete court rules on family housing and custody
The Provincial Court of Albacete has issued rulings regarding family law matters, specifically concerning housing rights and custody arrangements following divorce proceedings.
In one case, the court confirmed a decision requiring a 30-year-old adult to vacate the former family home. The ruling modified previous measures from a 2016 divorce, terminating child support for the adult son and returning the right to use the property to the father, who is the owner. The court rejected arguments that the adult son should have been a direct party to the proceedings, stating that an adult child does not possess an independent right to reside in the former family home; rather, their residence depends on the rights granted to the parents.
In a separate matter, the court upheld a shared custody arrangement for two minors and maintained the father's right to use the family home. Despite the mother's appeal for exclusive custody and concerns regarding her economic situation due to a temporary layoff (ERTE), the court determined there were insufficient reasons to deviate from the shared custody model, noting that routine changes are inherent to such arrangements.
