Albania judicial salaries dispute follows Constitutional Court ruling

A dispute has emerged in Albania regarding the payment of salaries for judges, prosecutors, and judicial administration staff. The conflict stems from a Constitutional Court decision that invalidated the previous salary formula, creating what Minister of Justice Toni Gogu describes as a legal vacuum.

Minister Gogu stated that while the Constitutional Court's decisions are mandatory, the Ministry of Finance cannot disburse public funds without clear legal authorization. He indicated that the issue must be resolved through the Parliament once the new session begins to establish a new legal basis for salary calculations.

In response, the Union of Judges, the National Association of Judges, and the Association of Prosecutors have expressed deep concern over the non-execution of payments. They argue that the High Judicial Council (KLGJ) and the High Prosecutorial Council (KLP) have already taken necessary steps to implement the court's decision following the expiration of the legislative deadline. The judicial organizations have rejected the Ministry of Finance's request to use the invalidated formula, asserting that the current impasse should not delay the rights of judicial officials.
