Albania legal reforms spark concerns over investigations and press freedom
Lawyer Adriana Kalaja has raised concerns regarding proposed changes to the Criminal Procedure Code in Albania, warning that the amendments could impact criminal investigations involving high-ranking officials and individuals close to the Prime Minister's family. Kalaja argues that the changes might establish “rules of the game” designed to serve the interests of those in power, potentially undermining political and moral accountability.
A key point of contention is the proposed weakening of the mechanism for justice collaborators and witnesses, which Kalaja claims is essential for uncovering evidence in significant criminal cases. She has also suggested that the reform process requires broader consultation, specifically mentioning the Venice Commission.
Additionally, debates have emerged regarding proposed restrictions on the press. Specifically, Article 103, point 14, seeks to prohibit the publication of materials from criminal files without court permission. Critics argue that instead of targeting journalists, the law should focus on punishing prosecutors who leak confidential investigative materials to the media, which often leads to public prejudice against defendants.
