Albania debates Criminal Procedure Code amendments

Albania is debating significant amendments to its Criminal Procedure Code, sparking a divide between government officials and legal experts. Minister of Justice Toni Gogu maintains that the revisions aim to strengthen citizen guarantees and align the country with European standards without weakening the fight against organized crime and corruption. He noted that 56% of people currently in pre-trial detention are held without a court decision, citing this as a long-standing issue.

Supporting the government, Theo Byl, a judge from the Antwerp Court of Appeal and Council of Europe expert, stated that the changes bring Albanian legislation closer to international standards. He noted that several proposals that could have hindered high-level corruption investigations were set aside during the drafting process.

However, critics and legal experts raise serious concerns. Some argue the draft law could establish a regime of prior censorship by restricting media reporting on investigative files, potentially violating the constitution and the public's right to information. Additionally, legal analyst Isuf Shehu pointed out a gap in the legislation regarding 'negative controls'—searches that do not result in seizures—noting that the draft lacks a mechanism for individuals to challenge the legality of such actions after they occur.
