Alex Mashinsky: Prosecutors urge rejection of motion to vacate Celsius sentence

U.S. federal prosecutors in the Southern District of New York have urged a judge to reject a motion filed by Alex Mashinsky, the former CEO of the collapsed cryptocurrency lender Celsius, to vacate his prison sentence.

Mashinsky, who is currently serving a 144-month sentence following a guilty plea to commodities and securities fraud, is attempting to represent himself pro se. His petition claims legal errors and ineffective assistance of counsel, while also referencing matters involving the cryptocurrency exchange FTX and former Celsius colleague Roni Cohen-Pavon.

Prosecutors argued that the motion is “without merit” and lacks legal substance. They noted that Mashinsky has not provided a sworn declaration to support his allegations and characterized his filing as an attempt to rehash issues already addressed during his sentencing or to shift blame to his previous legal team.
