STF Minister Alexandre de Moraes votes to equalize maternity and adoptive leave
Supreme Federal Court (STF) Minister Alexandre de Moraes has voted in favor of equalizing maternity and adoptive leave periods for women in Brazil. As the rapporteur of a case initiated by the Prosecutor General's Office (PGR) in October 2023, Moraes argued that the constitutional principle of equality prohibits distinctions between biological and adoptive children.
The proposed ruling would grant both biological and adoptive mothers 120 days of paid leave, with the possibility of a 60-day extension. This would apply regardless of the type of employment contract, aiming to correct disparities where public servants currently receive less leave than private-sector workers under the CLT (Consolidation of Labor Laws).
Under the proposed terms, the leave period would begin at childbirth or the granting of legal custody. In instances of hospitalization, the period would commence upon the discharge of either the mother or the child, whichever occurs last. Ministers Flávio Dino, Dias Toffoli, and Cármen Lúcia have already joined Moraes in his vote. The trial has been suspended and is scheduled to resume next week.
