Algerian wins annulment of implicit French residence permit refusal

The Paris Administrative Court publicly ruled that the prefecture of police erred by failing to provide a reasoned decision when it implicitly rejected a residence‑permit application from an Algerian national. The applicant had submitted his request on 22 April 2024 and, after more than four months of silence, the lack of a response was deemed an implicit refusal. A formal request for the motives was sent on 27 November 2024, but the prefecture again remained silent, prompting the applicant to bring the case before the tribunal.

At a public hearing on 23 June 2026, the prefecture offered no defence. On 9 July 2026 the court ordered the annulment of the implicit refusal, reminding the administration that French law obliges it to communicate the reasons for any adverse decision within a month.
