Alghero hospital ordered to pay damages after triage tent collapse

The Justice of the Peace in Sassari has issued a ruling ordering compensation for a woman injured during the COVID-19 pandemic in Alghero, Italy. The incident occurred on the morning of September 23, 2020, when a temporary pre-triage tent located in front of the Civil Hospital of Alghero collapsed.

The victim, a 74-year-old woman waiting for a medical visit, was struck in the right shoulder by the structure, resulting in a serious contusive trauma and a torn supraspinatus tendon. The injury caused several months of temporary disability.

In the ruling, Judge Marchesina Fenu applied the principle of objective liability of the custodian, determining that the hospital entity was responsible for ensuring the safety of the structures under its care. The decision follows a judicial process that included documentary evidence and testimony from the former Medical Director.
