Alicante City Council ordered to pay 12,000 euros for noise pollution

The Alicante Court of First Instance has ordered the Alicante City Council to pay 12,000 euros in compensation to two residents following persistent noise pollution from a nightclub located in their building's basement. The court awarded 6,000 euros to each neighbor for moral damages.

The ruling, issued by the Administrative Litigation Section, determined that the local government violated the residents' fundamental rights to personal and family privacy and the inviolability of the home by failing to act effectively against the acoustic disturbances. While the court did not find a separate violation of the right to physical and moral integrity, it acknowledged a serious impact on the residents' private lives.

In addition to the financial compensation, the magistrate ordered the City Council to conduct a complete acoustic inspection within one month of the sentence becoming final. This inspection must occur during the nightclub's normal operating hours at night to officially verify noise levels and implement necessary corrective measures.
