Alicante siblings face legal dispute over mother's ashes
Two siblings in Alicante are facing a legal battle over the ashes of their mother, who passed away in April 2025. A retired local police officer has filed a lawsuit against his sister, seeking 10,000 euros in compensation for moral damages.
The lawsuit alleges that the sister scattered their mother's remains without waiting for him, violating a prior agreement to perform the act together. According to the claim, WhatsApp messages between the siblings confirm an express agreement to decide on a time and place—specifically mentioning the pine groves of Castillo de Santa Bárbara—before proceeding.
The plaintiff's legal representative is invoking Article 1902 of the Civil Code, which mandates that anyone who causes damage to another through action or omission, involving fault or negligence, is obliged to repair that damage.
