Align Technology wins patent infringement lawsuit against Angelalign in China
The Jinan Intermediate People’s Court in China has issued a first-instance judgment in favor of Align Technology in a patent infringement lawsuit against Angelalign Technology’s Chinese subsidiaries. The court found that Angelalign’s use of its MasterForce biomechanical simulation system and ATreat digital orthodontic treatment design system to generate A7 and A7 Speed premolar extraction solutions infringes on Align’s patent related to extraction-gap-closure technology.
As a result of the ruling, the court ordered Angelalign to cease using the patented technology and to stop manufacturing and selling the infringing products within China. Align Technology was also awarded RMB 10 million in damages.
Angelalign has announced its intention to appeal the decision to the Supreme People’s Court, stating that the preliminary decision applies only in China and has not yet impacted customers or patients. The company maintains that its A7 Premolar Extraction Solution does not infringe any valid patents and noted that it has successfully won similar patent disputes in other jurisdictions, including a ruling by the Unified Patent Court in Germany that rejected Align’s request for an injunction.
