Allahabad High Court issues rulings on police compliance and departmental corruption

The Allahabad High Court has issued several rulings addressing administrative and procedural issues in Uttar Pradesh. In one instance, the court held that setting aside a quasi-judicial order does not automatically justify disciplinary action against the presiding officer unless misconduct is clearly established.

Regarding public tenders, the court ruled that clarificatory circulars issued after a complaint is lodged but before a decision is reached generally govern the pending proceedings, provided they do not unsettle previously crystallized rights.

The court also flagged police non-compliance with the Bharatiya Nagarik Suraksha Sanhita (BNSS) mandate, which requires audio-video recording of search and seizure operations. The bench noted that despite official circulars, this statutory requirement is “practically not implemented.”

Additionally, the court highlighted “disturbing circumstances” within the Uttar Pradesh Basic Education Department, noting frequent allegations of corruption and illegal gratification brought before the judiciary.
