Allahabad High Court protects couple who remarried after mutual divorce

The Allahabad High Court has granted legal protection to a couple who remarried following a mutual-consent divorce. A Division Bench, comprising Justices Rajesh Singh Chauhan and Ram Manohar Narayan Mishra, ruled that no private or public individual may obstruct the couple’s peaceful marital life.

The petitioners, who have two children, had previously obtained a divorce decree under Section 13B of the Hindu Marriage Act due to what the court described as “trivial disputes.” They later decided to remarry in the interest of their family and solemnized their union at an Arya Samaj temple on April 2, 2026.

The court expressed concern regarding the initial dissolution of the marriage, noting that the situation was “a sorry state of affairs.” However, citing legal precedents regarding the rights of adults to marry by choice, the bench held that the couple is entitled to live together without interference from family members who disapprove of the remarriage.
