Allahabad High Court rules employers cannot force staff to wear Santa Claus caps
The Allahabad High Court has ruled that employers cannot compel employees to wear Santa Claus red caps, noting that such mandates can hurt the sentiments of individuals belonging to different faiths and beliefs. Justice Saurabh Srivastava made the observation while presiding over a case involving employees of ‘V Bazar’ who were allegedly forced by superiors to wear the caps in 2022.
The Court stated that such compulsory actions are not permitted in a democratic system where citizens are free to follow their own faith and belief, adding that such instructions could disturb the peaceful and harmonious atmosphere of a workplace. The judge warned the applicant and superior authorities against repeating such instructions.
The legal challenge was brought by Vikram Singh, who sought to quash criminal proceedings under Sections 298 and 504 of the Indian Penal Code regarding the incident. The High Court determined that because the alleged offences were non-cognizable, the charge sheet should have been treated as a complaint rather than a state case, setting aside the previous summoning order while allowing the proceedings to continue as a complaint case.
