Almelo coffeeshops challenge new municipal licensing policy
Two coffeeshops in Almelo, Jemig de Pemig and De Tuin, have appealed to the Council of State following changes to local licensing regulations. The municipality has transitioned from issuing indefinite permits to fixed-term licenses with a five-year duration.
Under the new policy, permits are now issued to individual managers rather than the foundations that run the establishments. The municipality argues this change allows for better oversight of public order and facilitates Bibob investigations into the backgrounds of managers. Additionally, officials cited European regulations stating that scarce permits should not be granted indefinitely to ensure fair competition among potential applicants.
Lawyers for the coffeeshops contend that the municipality has changed the rules mid-game, creating significant uncertainty regarding their continued existence. The dispute centers on the impact of these policy shifts on the long-term stability of the existing businesses.
