ANAF proposes new digital consent rules for bank loan verifications

The National Agency for Fiscal Administration (ANAF) is preparing a new regulation to change how banks verify the income of clients applying for loans. Under the proposed order, the process of authorizing banks to access fiscal data will shift toward a digital-first approach.

Currently, clients provide consent to banks via physical paper documents or through the bank's own electronic applications. The new proposal aims to mitigate risks such as fraud, unauthorized data access, and the high costs associated with processing and archiving physical documents.

Under the new rules, companies and individuals who already use the Virtual Private Space (SPV) will be required to provide their consent exclusively through the SPV electronic platform. For individuals without an SPV account, the current system of signing via the bank will remain in place. Once consent is granted, it will be valid for five working days. The regulation is currently in the decision-making transparency phase and must be approved by ANAF leadership and published in the Official Gazette to become law.
