Anatel receives 5G compliance report and implements new oversight rules

The Monitoring Group for the Implementation of Solutions for Interference Problems in the 3.5 GHz Band (GAISPI) has submitted its 2025/2026 Yearbook to Anatel. The report evaluates the activities of the 3.5 GHz Band Administrator (EAF) regarding its compliance with 5G auction obligations. The assessment concludes that EAF activities are generally aligned with the objectives established in the 5G notice, noting significant progress in migrating satellite TV reception from the C-band to the Ku-band.

Simultaneously, a new regulation (Anatel Ordinance No. 3.207) has been issued to reinforce the autonomy of the EAF while expanding oversight of 5G infrastructure resources in Brazil. The ordinance establishes a control model based on specific parameters, goals, deadlines, and results. To enhance transparency, the regulation introduces an Independent Conformity Verification (VIC) to be conducted by a specialized third-party firm. This mechanism complements existing internal audits and specialized reviews currently being conducted on contracts and project execution since 2022.
