Brazil court awards damages to trans worker over bathroom discrimination
The Labor Court in Minas Gerais ordered a credit‑card administrator to pay R$ 13,200 in moral damages to a trans woman who faced discrimination during her fixed‑term contract. The judge, Carlos Adriano Dani Lebourg, found that the employee was directed to use a bathroom separate from the women’s facilities and that coworkers made trans‑phobic remarks. The court highlighted that the company failed to adopt effective measures to investigate or prevent such conduct, violating the worker’s dignity and personality rights. The decision cited Supreme Court and International Labour Organization standards, emphasizing that gender identity is a protected personal right.
The ruling also mandated confidentiality for documents that inadvertently disclosed another trans worker’s data and sent the case to the regional labor court for appeal. The company has appealed the decision.
