Andalusian Health Service ordered to pay 348,684 euros for surgical stroke

The Almería Court of First Instance has ordered the Andalusian Health Service (SAS) to pay 348,684.45 euros, plus legal interest, to a patient who suffered a stroke following surgery. The incident occurred on April 10, 2018, at the Torrecárdenas University Hospital during a procedure to treat a vascular tumor.

The court ruled that there was a breach of the 'lex artis' due to insufficient resources to handle a foreseeable complication and a lack of signed informed consent for certain procedures. Diagnostic tests following the surgery revealed an internal carotid artery dissection and an intracranial thrombus. The ruling emphasized that as a scheduled intervention, the SAS should have had the necessary means to respond immediately to such complications.
