Anthony Garotinho regains campaign rights via TSE ruling

The Superior Electoral Court (TSE) has overturned a decision by the Rio de Janeiro Regional Electoral Court (TRE-RJ) that had restricted the campaign of Anthony Garotinho. The TSE ruling allows the former governor to resume using party and electoral funds, participate in free television and radio advertising slots, and engage in debates during his bid for the Rio de Janeiro governorship.

Justice Floriano de Azevedo Marques, the rapporteur, granted the injunction to prevent “irreparable damage” to the campaign. He noted that because Garotinho’s candidacy registration is still sub judice, there is significant legal controversy regarding his eligibility, and he cannot be treated as “knowingly ineligible” until a final merit decision is reached.

The previous restrictions by the TRE-RJ were based on Garotinho’s conviction for administrative improbity, which the regional court argued resulted in the suspension of his political rights. While the TSE decision restores his campaign activities, it does not resolve the underlying legal question of his eligibility, which remains subject to future judicial review.
