Ankaran Municipality challenges Slovenia's noise decree at Constitutional Court
The Municipality of Ankaran has filed a legal challenge with the Constitutional Court of Slovenia, seeking to overturn the 2025 Decree on Limit Values of Environmental Noise. The municipality argues that the decree violates Article 72 of the Slovenian Constitution, which guarantees the right to a healthy living environment.
A primary point of contention is a specific provision that excludes noise generated by ships from the decree's regulatory scope. Ankaran officials claim this exclusion places residents near the Port of Koper and local anchorages at a legal disadvantage compared to those affected by other industrial or traffic noise. They argue there is no compelling reason to exempt maritime noise while regulating other sources.
The municipality also noted that the 2025 decree is strikingly similar to a 2018 version, which the Constitutional Court had previously ruled unconstitutional due to improper adoption procedures. Furthermore, the municipality highlighted warnings from the government's own legislative service regarding the unreasoned exclusion of ship noise and the resulting impact on residents' rights.
