ANP regulates access to LNG terminals in Brazil

The National Agency of Petroleum, Natural Gas and Biofuels (ANP) has implemented new regulations regarding access to Liquefied Natural Gas (LNG) terminals in Brazil. Following Resolution No. 1.003, published on July 1, 2026, third parties can now access these terminals on a negotiated and non-discriminatory basis.

This move aims to fulfill the objectives of the New Gas Law (Law No. 14.134/2021) by increasing market liquidity, diversifying suppliers, and improving infrastructure efficiency. However, the regulation introduces challenges for private assets, particularly those linked to the electricity sector. The new rules regarding the right of preference for terminal owners and the supervision of economic conditions may impact the investment logic and contract fulfillment for projects structured around long-term energy auctions.
