TCU orders study on alternatives to Enel's São Paulo concession termination
The Federal Court of Accounts (TCU) has recommended that the Ministry of Mines and Energy and the National Electric Energy Agency (Aneel) conduct a structured study on alternatives to the termination of Enel's energy concession in São Paulo. This recommendation comes amid ongoing regulatory processes regarding service failures, including issues following extreme weather events in 2023, 2024, and 2025.
The TCU established a 60-day deadline for the government and Aneel to present a detailed action schedule. The required analysis must demonstrate that any decision to terminate the contract would provide a net benefit to consumers. Key factors for the study include identifying potential new operators, establishing transition timelines, calculating compensation costs for reversible assets, projecting impacts on electricity tariffs, and assessing risks to the distribution sector.
Enel is currently contesting Aneel's findings of structural service failures. The decision to terminate the concession, known as caducity, remains subject to the conclusion of proceedings by Aneel and subsequent final approval by the federal government.
