Anthropic designated as supply chain risk by federal court

A federal court has upheld the Trump administration’s designation of the AI startup Anthropic as a ‘supply chain risk.’ This designation follows the company’s refusal to allow the Pentagon to use its technology for domestic surveillance or autonomous weapons systems.

The legal dispute highlights a shifting dynamic in military procurement. Unlike traditional defense contractors such as Lockheed Martin, where the government maintains full control over hardware, modern Silicon Valley firms like Anthropic, Palantir, SpaceX, and Anduril often retain ownership or control over the underlying technology.

Defense journalist Sharon Weinberger notes that this allows private companies to exert influence over how the U.S. military utilizes essential tools. This evolution suggests a move away from a model where the federal government holds absolute authority over military technology toward one where private entities can dictate terms of use for critical defense capabilities.
