Mercado Livre notified by Anvisa over prescription drug sales

Anvisa, Brazil's National Health Surveillance Agency, has formally notified Mercado Livre following the company's announcement that it will begin selling prescription medications through its marketplace starting in October.

The agency is seeking clarification on the legality of this operation, specifically requesting documentation regarding the company's sanitary authorization, the identification of a responsible pharmacist, and protocols for the storage, transport, and verification of medical prescriptions. Anvisa noted that current regulations do not explicitly authorize marketplaces to act as intermediaries for the sale of medications.

The move has drawn significant opposition from the Brazilian Association of Pharmacy and Drugstore Chains (Abrafarma), which has requested urgent clarification from Anvisa regarding the sanitary legality of the model. The announcement also triggered market volatility, impacting the stock prices of major pharmacy retailers such as Raia Drogasil and Pague Menos.

Mercado Livre has stated that it is in dialogue with regulatory bodies and maintains that its platform ensures full traceability and compliance with sanitary standards. The company plans to expand its pharmaceutical presence by integrating third-party pharmacies into its ecosystem, aiming to reach 20 partners by the end of the year.
