AOP Health wins €112 million arbitration award against PharmaEssentia
An International Chamber of Commerce (ICC) Arbitral Tribunal awarded AOP Orphan Pharmaceuticals GmbH (AOP Health) a total quantum award of about €112 million in its ongoing dispute with PharmaEssentia Corp over the interferon product BESREMi®. The award quantifies damage claims of roughly €82 million and a reimbursement of €31 million plus interest for overpayments made by AOP Health between 2019 and 2022, when PharmaEssentia was found to have overcharged up to 900%.
The tribunal also confirmed that PharmaEssentia overcharged AOP Health by an additional €65 million for deliveries in 2023‑2025. After set‑off of profit‑sharing payments of about €17 million, PharmaEssentia remains liable for a three‑digit‑million‑euro sum, while AOP Health owes nothing. AOP Health said the decision supports its effort to maintain stable patient access to BESREMi® for an estimated 12,600 patients.
