APEC economies seek to simplify cross-border commercial disputes

APEC economies are working to reduce the cost and complexity of resolving cross-border commercial disputes. This initiative follows challenges posed by digital trade, electronic contracts, and artificial intelligence, which are reshaping international business and creating new questions for private international law.

During a workshop in Dalian, Dr. James Ding, Chair of the APEC Economic Committee, noted that international legal instruments must adapt to technological advancements to provide investors with clarity on asset protection. Paul Lam, Secretary for Justice of Hong Kong, emphasized the need for innovative practices to address these evolving digital landscapes.

Dr. Christophe Bernasconi, Secretary General of the Hague Conference on Private International Law (HCCH), highlighted that legal certainty is as essential to economic integration as the movement of goods and capital. The goal is to ensure businesses can navigate jurisdictional differences, such as determining which courts have authority and whether judgments will be recognized across borders, particularly to assist small and medium enterprises.
