Apex Partners faces financial crisis and leadership dispute

Apex Partners is facing a significant financial crisis characterized by a net debt of 975 million reais and mounting pressure from upcoming debenture maturities and redemption requests. The company is currently seeking judicial authorization to maintain cash flow between its various entities, proposing to send biweekly reports to the court detailing all transactions to ensure funds are used for essential costs such as payroll, taxes, and vital suppliers.

The crisis follows the August 6 removal of president Fernando Antonio Kulnig Cinelli after audits allegedly identified financial inconsistencies. Apex has stated it will pursue legal action against Cinelli for alleged bad faith and reckless management. In response, Cinelli has requested the unblocking of his assets and the lifting of his bank secrecy, calling for an independent documentary investigation to clarify the company’s decision-making processes.

Corporate governance shifts have also occurred, including the resignation of Marcus Buaiz from the board of directors following the vote to remove the president and CFO. Marcelo Murad has been appointed as interim president to lead the firm through the restructuring period.
