Apple and Epic Games continue antitrust battle over App Store

Apple and Epic Games are engaged in a high-stakes antitrust legal battle regarding the operation of the App Store. Apple has argued in court that its 30% commission on developer revenue is a standard industry fee and is justified by the significant investments made into the proprietary infrastructure, such as software development kits and application programming interfaces, that support the marketplace.

Epic Games contends that Apple maintains an illegal monopoly by preventing developers from distributing iPhone and iPad apps through their own websites. The dispute also involves questions of whether Apple violated court orders, leading the Computer & Communications Industry Association (CCIA) to file an amicus brief with the Supreme Court. The CCIA argues against a “spirit” of an injunction test, suggesting that court orders should follow text-based standards to provide legal certainty for companies.
