Apple seeks to pause Epic Games App Store commission case as Supreme Court review looms
Apple has asked lower courts to suspend the litigation over its App Store commission policy while the U.S. Supreme Court considers the appeal in the Epic Games case. Epic Games responded with a strong objection, saying the move is a stalling tactic and that the case should continue without delay.
The dispute stems from Apple’s 30% fee on in‑app purchases and Epic’s bypass of that system in its game Fortnite. A 2021 district court order forced Apple to allow links to alternative payment options, yet Apple continued to charge up to a 27% commission, leading a judge to find Apple in contempt. The Supreme Court agreed in June 2026 to hear the appeal, with a decision not expected until June 2027.
