Argentina Federal Court Orders Review of Guillermo Moreno INDEC Manipulation Case

The Federal Court of Cassation (Cámara Federal de Casación Penal) annulled a previous ruling that rejected a request to assess prescription in the criminal case against former Commerce Secretary Guillermo Moreno and former INDEC official Beatriz Paglieri. The court instructed the Tribunal Oral Federal No. 2 to issue a new decision evaluating whether the continued presence of former INDEC employee Marcela Filia effectively suspended the prescription period for the alleged manipulation of the Consumer Price Index (CPI) between 2006 and 2007.

The majority opinion, authored by judges Alejandro Slokar and Mariano Borinsky, held that the lower court’s reasoning was insufficient, while judge Javier Carbajo dissented. If the new assessment finds that Filia did not have the hierarchical authority to influence the investigation, the criminal action could be declared prescribed, potentially nullifying the 2024 three‑year suspended‑sentence and six‑year disqualification imposed on Moreno and Paglieri for abuse of authority and tampering with public records. The case will be returned to the Tribunal Oral Federal No. 2, now composed of judges Jorge Gorini, Rodrigo Giménez Uriburu and Néstor Costabel, for that specific analysis.
