Argentina advances laws on criminal recidivism and rural vandalism

The Chaco Legislature has approved the ‘Ley de Reiterancia’, a reform to the provincial Criminal Procedure Code. The law allows judges and prosecutors to consider a person’s history of similar criminal activities as an objective criterion for ordering preventive detention. This measure aims to address the ‘revolving door’ phenomenon, where individuals are repeatedly released and re-arrested, without equating recidivism with a final conviction.

Separately, the Argentine Congress is debating a bill to criminalize ‘rural vandalism’. Supported by agricultural organizations such as Confederaciones Rurales Argentinas (CRA), the project seeks to introduce the figure of ‘rural intrusion’ and ‘aggravated damage’. It proposes prison sentences of one month to one year for unauthorized entry into delimited rural properties, and two to eight years for the intentional destruction of crops, livestock, or essential infrastructure like irrigation systems and solar panels.

In Chaco, Governor Leandro Zdero welcomed the legislative reform as a necessary tool for public security, while opposition members noted that the law provides tools but does not substitute for effective government management.
