Argentina eases biotech patent rules, launches promotion scheme

The National Institute of Industrial Property (INPI) of Argentina issued Resolution 197/2026, revising its patent guidelines for living matter. The new rules restore original exclusion criteria for plants, animals, their parts and essentially biological processes, clarifying that these are not considered inventions under article 6 g) of the Patent Law. Claims for products derived from such organisms remain excluded, even when created through recombinant DNA technology.

Separately, the Ministry of Economy announced a competition under Resolution 138/2026 for biotechnology and nanotechnology projects to access a promotion regime. The program allocates a fiscal quota of 2 billion Argentine pesos and offers incentives such as accelerated depreciation, early VAT refunds, and a 50% tax credit for R&D expenses with national research institutions. Applications are open to Argentine individuals and legal entities until 31 July 2026, with evaluation based on economic impact, job creation, sustainability, export potential and support for micro‑ and small‑technology firms.
