Argentina enacts housing reforms to speed evictions and loosen construction guarantees

The Mendoza provincial legislature approved a law that amends the Civil Procedure Code to create a fast‑track monitorio process for evictions carried out by the Instituto Provincial de la Vivienda (IPV). The reform allows IPV to file eviction suits directly using its administrative dis‑allocation orders, limits the effect of appeals, and standardises notifications, thereby reducing the ability of occupants to delay court proceedings.

At the national level, a draft amendment to the Law against Real Estate Fraud was introduced in the Assembly. The proposal reduces oversight of sales and pre‑sale contracts, lets developers choose among performance bonds, insurance policies or real‑estate trusts instead of a full‑price bank guarantee, and authorises price adjustments linked to market fluctuations. The changes are presented as part of the government’s response to the June 24 earthquakes and aim to stimulate construction while maintaining buyer protection through general contractual conditions.
