Argentine Federal Chamber rules in $LIBRA and IMF loan cases
The Argentine Federal Chamber's Room I has issued two significant rulings involving high-profile political figures. In the $LIBRA cryptocurrency case, judges Pablo Bertuzzi and Mariano Llorens confirmed the exclusion of five investors—Alan Vega, Braian Emanuel Quintero, Matías Alejandro Paris, Juan Patricio Marchetto, and Martín Romeo—as private prosecutors. The court ruled that these individuals failed to prove a specific deceptive maneuver and noted that they voluntarily assumed the risks inherent in a volatile, unregulated market. While the ruling weakens the fraud hypothesis, the court clarified it is not a final decision on the merits of the case.
In a separate matter, the same chamber confirmed the dismissal of the investigation into former President Mauricio Macri and current Economy Minister Luis Caputo regarding a $57 billion IMF loan agreement from 2018. The judges ruled that the agreement was a political decision and that the prosecution failed to prove criminal conduct, stating that the judiciary is not tasked with reviewing the efficacy of government economic decisions. This decision upholds a previous ruling by Judge María Eugenia Capuchetti and rejects appeals from the prosecution.
