Argentina implements new requirements for judges over 75

The Argentine government has implemented new regulations for judges and public prosecutors seeking to extend their terms beyond the constitutional age limit of 75. Through Resolution 384/2026, signed by Justice Minister Juan Bautista Mahiques, the Ministry of Justice has established a more rigorous procedure for those requesting a five-year extension.

Under the new rules, applicants must submit their request during the year preceding their 75th birthday. Required documentation includes a national ID, university degree, curriculum vitae, and a comprehensive asset declaration. Candidates must also provide certification regarding their disciplinary status, ensuring they are not subject to ongoing impeachment proceedings, removal processes, or judicial jury reviews.

The reform introduces increased transparency and oversight. The Ministry of Justice will publish requests in the Official Gazette for one day and host applicant backgrounds on its website for public consultation. Additionally, the Agency for Tax and Customs Control (ARCA) will verify the tax and social security compliance of the magistrates. Once the administrative process is complete, the President decides whether to submit the nomination to the Senate for approval.
