Argentina proposes adoption rights for long-term foster families

A legislative proposal has been introduced in the Chamber of Deputies to allow children to be adopted by their foster families if they have been under their care for more than one year. Presented by Deputy Nicolás Massot of Encuentro Federal, the bill aims to ensure that judges specifically consider the emotional bonds formed when a temporary foster arrangement extends over a long period.

The project stipulates that if a child remains with the same foster family for more than 365 days, the judge must prioritize evaluating that relationship before deciding the child's future. The proposal does not grant automatic adoption rights nor does it force foster families to adopt. Interested families must express their intent, undergo a comprehensive suitability evaluation, and join the official registry of adopters.

Final decisions remain with the judge, who must act in the best interest of the child. In making a ruling, the magistrate is required to analyze the duration and quality of the relationship, home stability, continuity of care, and the potential impact of separation. The child's opinion must also be heard, according to their age and maturity.
