Argentina proposes new labor rights for digital platform workers

National Deputy Vanesa Siley has introduced a legislative project titled the Care Law for Persons Working in Digital Platform Services. The initiative aims to establish a specific rights regime for workers delivering or retrieving goods via applications such as Rappi, PedidosYa, Uber, and Cabify.

Key provisions of the proposal include the right to flexible scheduling and the definition of working time as the period from when a worker logs into the app until they disconnect. The project also seeks to implement algorithmic transparency, granting workers the right to understand the parameters used by algorithms for employment decisions and profile creation. It further prohibits arbitrary blocking, requiring companies to provide a right to defense before disconnecting a user.

Additional measures include the creation of public sanitary stations for delivery workers, the implementation of an emergency security button within the apps, and ensuring compatibility with social welfare programs. The project also proposes mandatory support channels with physical locations and local telephone access, as well as recognizing digital reputation as a worker's own capital.
