Argentina rental laws spark debate over express evictions

New legal frameworks and proposed legislation in Argentina regarding “express evictions” are sparking debate between tenant advocates and real estate professionals. In Neuquén, the Federación de Inquilinos Agrupados has warned that new judicial regulations, including a revised Civil and Commercial Procedural Code, could exacerbate the housing crisis. Advocates argue that accelerated eviction timelines leave families, including those with children or disabilities, in a state of defenselessness during a period of high debt and market deregulation.

Conversely, real estate experts suggest that these changes, including the proposed “inviolability of private property” law, may offer a mechanism to limit debt accumulation for tenants. Lucas Péndola, president of the Colegio de Corredores Inmobiliarios de Córdoba, noted that the “express eviction” model could allow tenants who can no longer afford rent to return keys to the owner immediately. This would prevent the continuous growth of debt that typically occurs during lengthy traditional eviction processes, as owners would be obligated to accept the return of the property.
