César Milani: Supreme Court overturns acquittal in 1976 soldier disappearance case

The Supreme Court of Argentina has overturned the acquittal of former Army Chief César Milani in a case involving the 1976 disappearance of soldier Agapito Ledo. The court ordered the case to be returned to the Federal Chamber of Criminal Cassation for a new ruling with a different panel of judges.

The ruling follows arguments from interim Attorney General Eduardo Casal, who contended that previous acquittals were insufficiently founded on the evidence. The prosecution argued that lower courts failed to exhaustively evaluate circumstances suggesting Milani may have covered up Ledo's illegal detention by falsely documenting it as a desertion.

The decision was reached by a majority including judges Horacio Rosatti and Ricardo Lorenzetti, along with associate judge Juan Ignacio Pérez Curci. Judge Carlos Rosenkrantz dissented, maintaining that the acquittal should stand as the evidence did not prove Milani's involvement beyond a reasonable doubt.
