Argentina Supreme Court rejects challenges to judges in university funding case

The Supreme Court of Argentina dismissed the national government's attempts to recuse judges Enrique Cormick and Sergio Fernández from a case concerning the constitutionality of decree 759/2025 and law 27.795, which govern university financing and teacher salary adjustments. The high court, in a decision signed by justices Ricardo Lorenzetti, Horacio Rosatti and Carlos Rosenkrantz, held that academic activity—even when remunerated—does not by itself demonstrate a personal interest that would compromise impartiality, and stressed that recusations must be applied restrictively. The dispute originated from a collective amparo filed by the National Interuniversity Council and several public universities, seeking to declare the decree unconstitutional and to have its funding provisions incorporated into the general budget. Lower courts had ordered partial compliance with the law, prompting the state’s challenge. Following the ruling, the teachers' union announced a new week‑long strike from 16 to 20 June, coordinating with other federations, while no salary increase offer has been made by the government.
