Argentina workplace risk insurer litigation projected to reach 138,000 lawsuits
Labor litigation involving workplace risk insurers (ART) in Argentina remains at high levels, with projections suggesting nearly 138,000 new lawsuits could be filed by the end of 2026. According to the Unión de Aseguradoras de Riesgos del Trabajo (UART), 72,525 new claims were accumulated during the first seven months of the year.
While the total number of active lawsuits has shown relative stability in some aggregate metrics between 2023 and early 2026, the internal market landscape is shifting. Different insurance entities are experiencing varying levels of litigation growth and market share changes. For instance, Federación Patronal includes its ART operations within its consolidated data, making it distinct from pure workplace risk insurers.
UART has noted that Argentina's litigation rates are significantly higher than in other nations, with levels exceeding those of Chile by 23 times and Spain by 16 times. The industry group continues to advocate for measures to reduce what it describes as unjustified claims to improve the predictability of the system, which currently covers over 10 million workers.
