Argentina's Federal Court of Cassation issues key rulings on seized assets and full‑agreement reviews

The Federal Court of Cassation (CFCP) in Argentina reversed a prior decision that had declared Decree of Necessity and Urgency 575/25 unconstitutional. By a ruling led by judges Mariano Borinsky and Javier Carbajo, the court reinstated the decree, allowing the Ministry of Justice to administer assets seized in criminal cases.

In a separate ruling, judge Ángela Ledesma affirmed that judges may oversee the legality of full‑agreement settlements but cannot replace the prosecutorial strategy of the Ministry of Public Prosecutor. The decision concerned a case of aggravated free supply of narcotics involving minors, emphasizing the separation of functions under the Federal Criminal Procedure Code.
