Argentina's INPI Introduces New Rules for Trademark Nullity and Expiry

On 6 July 2026 the Argentine National Institute of Industrial Property (INPI) issued Resolution 215/2026, replacing the regulations governing administrative procedures for trademark nullity and expiry. The resolution adds explicit rules for the electronic unarchiving of the challenged trademark file and requires the initiating party to notify the trademark holder—or the foreign holder’s legal representative in Argentina—by a reliable means before the action proceeds. Notification must identify the unarchived file and state that future communications will use INPI’s electronic portal; proof of notification is deemed sufficient regardless of outcome. The notification must be completed within 60 days of the order to unarchive, and failure to do so may allow INPI to reject the action outright. These measures aim to strengthen defense guarantees for trademark owners and provide greater procedural predictability.

The reform imposes a new procedural burden on parties filing nullity or expiry actions while enhancing the rights of registered owners to be aware of electronic file reactivation before substantive proceedings continue.
