Argentine court orders bus company to pay 44.9 million pesos

The National Chamber of Civil Appeals in Argentina has ordered the transport company Nueva Ideal S.A. to pay 44,920,000 pesos in compensation following an accident involving a minor in San Justo, La Matanza.

The incident occurred on May 16, 2022, when Mariano Correa Ojeda was traveling on a line 382 bus. The driver performed a sudden braking maneuver to avoid people pushing a vehicle on the road, causing the teenager to lose his balance and fall inside the unit. The fall resulted in a fractured left proximal tibia, as well as various traumas and abrasions.

The court ruled that the maneuver could not be justified as an unforeseeable event, noting that the driver had previously observed the situation on the road and should have taken extra precautions. The compensation covers incapacity, moral damages, and psychological treatment, plus applicable interest.
