Argentina Supreme Court reinstates rural land ownership limits for foreigners

The Supreme Court of Argentina has issued an interim injunction to temporarily reinstate restrictions on the acquisition of rural land by foreign entities. This decision suspends the effects of Article 154 of Decree 70/2023, which had repealed the Land Law (Law 26.737) under the administration of President Javier Milei.

The ruling was reached through a split vote, with Justices Horacio Rosatti and Ricardo Lorenzetti joined by associate judges Diego Barroetaveña and Juan Ignacio Pérez Curci. Justice Carlos Rosenkrantz dissented, questioning the court's competence to issue such a measure at this procedural stage.

The legal challenge was brought forward by the environmental organization Árbol de Pie, alongside indigenous communities such as the Lafkenche and Lof Fvta Anecon. The plaintiffs argue that the repeal of the Land Law threatens environmental protection and the rational use of natural resources.

The injunction will remain in effect until the Federal Court of Bariloche determines the legal standing of the plaintiffs and examines the merits of the request. This judicial intervention occurs amid political tension, as the government seeks to protect the deregulation package contained in DNU 70/2023 from potential repeal in the Chamber of Deputies.
