Argentine courts rule on school nutrition and abortion access protocols
In Argentina, two separate judicial rulings have addressed public rights and health protocols.
In Entre Ríos, Judge Juan Malvasio has called for individuals affected by the new provincial school breakfast system to join an ongoing legal challenge. The lawsuit, filed by the Asociación Gremial del Magisterio de Entre Ríos (Agmer), the NGO Fundación Cauce, and several families, seeks to protect children from receiving industrialized food products that may harm their health. While a previous injunction was appealed by the State Prosecutor's Office, the matter is currently pending a decision by the Superior Tribunal of Justice.
In San Isidro, an Administrative Court has ordered the suspension of a municipal protocol that created barriers to legal abortion access. The court ruled that the local protocol violated National Law 27.610 by imposing unauthorized requirements, such as mandatory psychological consultations and social team interventions. Amnesty International Argentina argued that these measures, which included concentrating services at a single hospital and using pressure tactics, functioned as obstacles to a recognized legal right.
