Argentina: Court orders government to implement University Financing Law

Federal Judge Martín Cormick has declared Decree 759/2025 unconstitutional, ordering the Argentine government to immediately implement the University Financing Law (Law 27.795). The ruling follows legal challenges from the National Interuniversity Council (CIN) and the University of Buenos Aires (UBA), asserting that the President cannot suspend legislation ratified by Congress.

The judicial decision invalidates the clause in the decree that conditioned the law's application on Congress determining specific funding sources. The mandate covers essential resources for university salaries, scholarships, research, and hospital operations.

In response to the ruling, the administration of President Javier Milei has announced its intention to appeal. Meanwhile, tensions have escalated on the ground; students recently occupied the Palacio Pizzurno, the headquarters of the Secretariat of Education, to demand compliance. The Federal Police eventually cleared the building using tear gas. These protests serve as a precursor to a planned Federal University March scheduled for October 15.
